What Does the Law Say About Drug Possession?
The offence of drug possession occurs when someone possesses (unlawfully) or controls any controlled substance.
To commit the offence of drug possession, the individual only needs to be aware of their possession of the item. They do not need to be aware that the item in question is a controlled drug.
Regarding the 'control' aspect of the drug possession offence, the drug may be in another person's possession, but if the accused was in control of the drugs, they could still be convicted of this offence.
The Misuse of Drugs Act 1971 addresses most drug-related offences, including those pertaining to drug possession.
Section 5 of the Act encompasses the offence of drug possession, as well as possession with intent to supply.
What if I Believed the Drug I Had in My Possession Was a Different Drug?
You will be charged for drug possession of the actual drug. Even if you believed the drug in your possession to be a different type of drug, it is the drug you are actually in possession of that matters.
