What is rape?
The legal definition of rape is when a man intentionally penetrates the mouth, vagina, or anus of another person with their penis, without consent. According to the law, only a man can commit rape, as the penetration must involve a penis. However, a woman can be convicted of rape if she aids a man in an attack.
Rape is among various sexual offences outlined in the Sexual Offences Act 2003. Others include sexual assault, assault by penetration, and possession of indecent images of children.
What does the law say about rape?
The offence of rape is defined in Section 1 of the Sexual Offences Act 2003.
This stipulates that a person (A) commits rape if:
(a) he intentionally penetrates the vagina, anus, or mouth of another person (B) with his penis,
(b) B does not consent to the penetration, and
(c) A does not reasonably believe that B consents.
Determining whether the belief is reasonable involves examining all the circumstances surrounding the potential rape, including any measures the alleged offender took to ascertain the other person's consent.
